Re: Urgent Medical Care Requested for Inmate Case #S53807, Rusty Lee Rhoton,ID#39029, Sullivan County Detention Center, Tennessee

As a result of a motorcycle wreck in May of 2005, Rusty received a closed head injury which presented with various mental symptoms. He has partial complex seizures , polycythemia, sleep apnea, COPD & right hemisphere brain damage. All of which can affect his memory and mental condition. Polycythemia is deadly and repeated seizure/stroke activity can cause brain damage. Specialized medical treatment is needed as soon as possible.

It was discovered June 2007, he was having partial complex seizures which appear as mental symptoms. He has been misdiagnosed off and on with various mental conditions and put on various medications that made him agitated and psychotic instead of receiving proper medical care as needed for the complex seizures. Since the accident, his family, has become aware of how his medications were causing his behavior. Rusty has now been diagnosed to have polycythemia, a rare blood disorder causing seizure and mini stroke activity. He had been receiving blood treatments every two weeks and then every month before incarceration. The jail did one treatment almost 5 months and another blood treatment April 3; but still have not addressed his partial complex seizures.

Rusty’s mental state has been unstable since April of 08. He has undergone many tests trying to piece together what was causing his polycythemia, seizure disorder, neurological problems, and difficulty communicating at times. Rusty had a severe seizure September. 9, 08 which left him very confused. Due to his mental state he was admitted to Ridgeview on September 10 for 9 days. His hematologist stated Rusty needs to go to a large university hospital where they are more familiar with his polycythemia to differentiate between the seizure and mini stroke activity. His doctor in Asheville NC said he would not find anyone in the Tri-cities to treat his partial complex seizure disorder. When he was incarcerated on Nov. 17, the jail took his medications and destroyed.

Rusty is having to endure cruel and unusual punishment by not receiving proper medical treatment at the jail. He has a Federal Civil Rights lawsuit in Greenville asking for proper medical treatment. Upon discovery of this lawsuit, the jail then gave him token treatment. He is kept in 23 hour lock up due to his mental instability which has worsened over the months without treatment. He had been receiving blood treatments every two weeks and then every month before incarceration. He is not allowed interaction, TV or access to the outdoors for exercise. He has stated he is not receiving enough to eat to maintain his normal weight. At times he is unable to fill out the order form to obtain food from the commissary for snacks. He can’t communicate well with the officers or fill out required medical forms; therefore, he does not get the help as it is needed. The lack of proper and necessary medical care is causing him to continue to get worse due to their lack of treatment.

Polycythemia is deadly without treatment. He could have a stroke or heart attack. It has been suggested Rusty is a candidate for rehabilitation at Crumley House once his medical conditions are stable.

The URGENT and IMMEDIATE need to get Rusty out of jail enabling him to be taken to Duke University Hospital or another large hospital for proper treatment. He has spent over 5 months in inhumane conditions. He needs to be in the hospital getting his medical needs addressed. Due to Mr. Rhoton’s medical condition there is not time to wait on the appeal process, as he is getting worse physically & mentally each day.

Please consider an immediate exoneration for Rusty Rhoton where he no longer has to suffer due to improper medical care before he dies inside the jail due to lack of proper medical care.

Prison is NOT the proper place for people with this type of mental, health, issues and problems. Prison is not for punishment, it is the punishment.
